A new lawsuit has been filed under the New York Child Victims Act against a former employee at the Western New York Children’s Psychiatric Center in West Seneca. According to the lawsuit, the accuser, who was admitted to the center at the age of 12, was allegedly sexually assaulted and abused by Marshall Krzos, a nurse at the center, for months. A Buffalo News article from 1989 states that Krzos pleaded guilty to two counts of sex abuse. The article also states that Krzos was one of several staff members found to be abusing patients at the center in the 1980s.
Sexual Abuse Victim’s Rights Under the New York’s Child Victims Act
In February 2019, New York passed the Child Victims Act. Under this new law, victims of child sexual abuse and assault, including those sexually abused by health care professionals, have until the age of 55 to file a civil lawsuit against their attackers and the institutions that protected them. Criminal felony charges can be sought until the victim is 28 years old and misdemeanors can be filed until the victim is 25 years old.
In situations where the statute of limitations has already expired, the CVA also allows the survivors of child sexual abuse a one-time “look back” window of time to file civil claims. This means regardless of how old you were when sexually abused, you have until August 14, 2020 to file a sex abuse related action against the appropriate defendants.
